<p><strong>Disclaimer</strong>
Please refrain from publicizing gallery names, artist names, or artwork images before <strong>September 1st</strong>.</p>
<p><strong>Customs declaration</strong>
ATA Carnet is not suitable for artworks intended for sale in Japan. Our exhibitor liaisons will assist with a step-by-step guide for customs declarations in Japan, together with our logistics partner, Yamato.</p>
<p><strong>Mutual sign-off on Condition Reports (CR)</strong>
All works must be accompanied by condition reports signed at three key stages: upon receipt of delivery, upon completion of installation, and at hand-back during de-installation. These signed reports document the condition of each work throughout the process and clearly establish responsibility in the event of any damage, loss, or discrepancy.</p>
<p><strong>Art Insurance</strong>
This clause refers specifically to artwork insurance, not general liability or event insurance. Exhibitors are responsible for arranging and maintaining individual artwork insurance coverage for their works up to delivery, during installation and de-installation, during the event, and for return shipping after de-installation.</p>
<p><strong>International Shipping and Customs Responsibility</strong></p>
<p>Any artwork, display equipment or other item shipped into Japan must be lawfully imported and cleared through customs before it is delivered to TJC’s designated delivery location.</p>
<p>The Exhibitor, or a third party appointed by the Exhibitor, must act as the importer. TJC, the TJC Executive Committee, the Venue and the Venue operator must not be named as the importer, consignee, customs declarant, taxpayer or Attorney for Customs Procedures without TJC’s prior written consent.</p>
<p>The use of the Venue address as a delivery address does not make TJC or the Venue the importer or consignee.</p>
<p>TJC may provide general guidance, document templates and introductions to logistics or customs providers. Such assistance is provided for coordination purposes only and does not make TJC responsible for the importation, customs clearance or tax obligations of the Exhibitor.</p>

<h2>Exhibition Terms</h2>

<li>Transfer fees are the responsibility of the exhibitor.</li>

<li><strong>If the remaining balance is unpaid by October 25</strong>: Issuance of staff passes, artwork installation, and sales support may be withheld until payment is confirmed.</li>
<li><strong>Cancellation</strong>: Participation fees already paid are non-refundable. In cases of force majeure, we will discuss postponement, substitution, or credit toward a future edition.</li>
<li><strong>Staff Passes</strong>: Up to 3 per gallery, free of charge.</li>
<li><strong>Included</strong>: Venue, curation, installation, on-site operations during the run, PR, insurance during installation, and three complimentary staff passes.</li>
<li><strong>Not Included</strong> (out-of-pocket, gallery's responsibility): Shipping costs, customs duties and import consumption tax, insurance for the periods up to delivery, during the run, and for return shipping, special installation costs, payment processing fees, additional staff costs.</li>
</ul>
<h2>Curation & Installation</h2>
<ul>
<li>On-site installation is carried out by TJC. Exhibitors are responsible only for delivering the artwork.</li>
<li>TJC will work closely with exhibitors to place artwork in the best context within the overarching exhibition. Exhibitors are asked not to submit requests for location.</li>
<li>Technical requirements and conservation notes for each work can be shared via the Artwork Information form.</li>
</ul>
<h2>Submitting Artwork Info & Promotional Materials</h2>
<ul>
<li><strong>Gallery & artist information</strong>: submitted via a dedicated promotional materials form.</li>
<li><strong>Artwork information</strong> (per artwork, up to 10 works): size, weight, installation requirements, insured value.</li>
<li><strong>Image Specifications</strong>:<ul>
<li>Long edge at least 3,000px (300dpi recommended)</li>
<li>JPEG (sRGB) or TIFF format</li>
<li>At least 3 images per work (overall, detail, and installation view if possible)</li>
<li>File naming: "GalleryName_ArtistName_WorkTitle"</li>
</ul>
</li>
<li><strong>Upload Method</strong>: Attach directly to the form (up to ~1GB, no account required). For larger print-resolution files (several GB), please provide a WeTransfer or similar download link within the form.</li>
<li><strong>Language</strong>: All text must be submitted in English and ideally also in Japanese. Translation is the gallery's responsibility.</li>
<li><strong>Text Length</strong> (per language):<ul>
<li>Gallery overview: up to 150 words (400 characters in Japanese)</li>
<li>Artist bio: up to 150 words (400 characters in Japanese)</li>
<li>Artwork description: up to 100 words (400 characters in Japanese)</li>
</ul>
</li>
<li><strong>Credit Lines</strong>: Image credits, artist names, and courtesy lines will be published exactly as submitted.</li>
<li><strong>Scope of Image Use</strong>: Website, social media, press, print materials, venue signage, sponsor/grant reporting, and archives. No major alterations, merchandising, unrelated advertising, or AI training use will occur.</li>
<li><strong>Communication & Social Media</strong>: Please do not publish any information about gallery participation in Tokyo Jazz Club before September 1st. After this date, please help by tagging/co-posting with TJC. Media inquiries should be directed to the TJC PR contact.<ul>

</li>
</ul>
<h2>Shipping & Customs</h2>
<p><strong>Exhibitor Responsibility</strong></p>
<p>Each Exhibitor is responsible, at its own expense, for arranging the international and domestic transportation, importation, customs clearance, storage and re-export of its artwork, display equipment and other goods in compliance with all applicable laws and regulations.</p>
<p>The importer must be the Exhibitor or a third party appointed by the Exhibitor. TJC does not act as the importer, consignee, customs declarant, taxpayer, customs broker, tax agent or Attorney for Customs Procedures.</p>
<p><strong>Shipping and Customs Documents</strong></p>
<p>The Exhibitor must ensure that all invoices, packing lists, bills of lading, air waybills, import declarations and other shipping or customs documents are complete and accurate.</p>
<p>TJC, the TJC Executive Committee, the Venue and the Venue operator must not be identified as the importer, consignee, customs declarant or person responsible for duties or taxes without TJC’s prior written consent.</p>
<p>The Venue address may be shown as the final delivery address only. Its use does not make TJC or the Venue the importer or consignee.</p>
<p><strong>Costs and Additional Charges</strong></p>
<p>All costs relating to transportation, importation, customs clearance, duties, import consumption tax, customs brokerage, storage, return shipping and re-export are the Exhibitor’s responsibility.</p>
<p>This also applies to additional duties, taxes, penalties, late-payment charges, storage charges or other costs arising from incorrect or incomplete declarations, changes in the use or status of a work, a sale, or failure to comply with the applicable import procedure, including costs charged after the Event.</p>
<p>If any such amount is invoiced to or paid by TJC, the Exhibitor must reimburse TJC in full within seven (7) days of TJC’s request.</p>
<p><strong>Temporary Import and ATA Carnet</strong></p>
<p>An ATA Carnet or another temporary-import procedure may be appropriate for works that are expected to be re-exported.</p>
<p>If a temporarily imported work is sold or is to remain in Japan, it must not be released or delivered to a purchaser or other third party until all procedures required for lawful domestic importation have been completed and all applicable duties and taxes have been paid.</p>
<p>Any temporarily imported work that will not remain in Japan must be re-exported within the applicable deadline at the Exhibitor’s responsibility and expense.</p>
<p>Exhibitors should confirm the appropriate import procedure with their customs broker before shipment.</p>
<p><strong>Verification Before Delivery</strong></p>
<p>TJC may refuse to accept, display, permit the sale of or store any work where lawful importation and customs clearance cannot be verified.</p>
<p>Artworks should not be dispatched to the Venue until the Exhibitor has confirmed its importer, customs arrangements, required documents and delivery schedule.</p>
<p><strong>Customs-Related Liability</strong></p>
<p>TJC is not liable for losses arising from transportation or customs delays, denial of clearance, detention, seizure, additional tax assessments or other import/export issues, except to the extent caused by TJC’s willful misconduct or gross negligence.</p>
<p>This provision relates to shipping, importation and customs matters and does not replace the separate provisions concerning artwork insurance and Condition Reports.</p>
<h2>Delivery Schedule</h2>
<ul>
<li><strong>Delivery Time Slots</strong>: Once the final floor plan is confirmed (10/1), each gallery will be assigned a delivery slot, communicated via the final load-in/out manual.</li>
<li><strong>Packing Requirements</strong>: Please use reusable packaging and appropriate cushioning materials. Wooden crates are recommended for high-value or fragile works. Packing materials will be stored off-site for return shipping.</li>
<li><strong>Customs Documents</strong> (for international works): Commercial invoice / packing list / HS code (artworks fall under Chapter 97).</li>
</ul>
<h2>Insurance & Condition Reports</h2>
<p><strong>Insurance Responsibility by Period</strong></p>
<p>This clause refers specifically to artwork insurance, not general liability or event insurance. Exhibitors are responsible for arranging and maintaining individual artwork insurance coverage for their works up to delivery, during the event, and for return shipping after de-installation. Tokyo Jazz Club will provide insurance coverage during the installation period, from receipt of delivery until completion of installation, subject to the completion and signature of all required condition reports.</p>

<p>For periods that are the gallery's responsibility, please arrange insurance appropriate to the artwork's appraised value and submit proof of coverage as instructed by your exhibitor liaison.</p>
<p><strong>Condition Reports (CR) and Transfer of Responsibility</strong></p>
<ul>
<li>TJC will photograph and record the condition of each work at delivery, unpacking, post-installation, pre-deinstall, and after repacking.</li>
<li>All works must be accompanied by condition reports signed at three key stages: upon receipt of delivery, upon completion of installation, and when artworks are returned after de-installation.</li>
<li>These signed reports document the condition of each work throughout the process and clearly establish responsibility in the event of any damage, loss, or discrepancy.</li>
<li>High-value or fragile works are subject to individual confirmation (please indicate this on your artwork information submission).</li>
</ul>
<h2>Artwork Sales</h2>
<ul>
<li>As part of its broader sales initiative, Tokyo Jazz Club will apply a 10% commission on all artwork sales.</li>
<li>A dedicated team of sales representatives and art advisors will work closely with exhibitors before, during, and after the event to actively support sales efforts and help close deals.</li>
<li>All artwork information will be handled with accuracy and care, with full respect for any sensitive, confidential, or privileged information shared by exhibitors.</li>
<li><strong>The sales commission is calculated at 10% of the artwork's base sale price.</strong> Out-of-pocket costs such as production, shipping, insurance, duties, import consumption tax, and installation fees are excluded from this calculation.</li>
<li>Please report any sales made during the event, or any sale resulting from TJC within 60 days after the event, <strong>within 7 days of the sale</strong>. Please submit your final sales report, even if there are no sales, by January 8, 2027.</li>
<li>Accurate reporting is appreciated for grant applications and program reporting purposes.</li>
</ul>
<h2>VIP & Invitations</h2>
<ul>
<li>Please submit VIP candidate information (name, affiliation, invited by, etc.) by 9/1.</li>
<li>VIPs themselves do not need to pre-register. Names will be confirmed at reception on the day.</li>

<h2>Photography & Social Media Rules</h2>
<ul>
<li>Documentation of artwork must be scheduled before opening hours with our exhibitor liaisons.</li>
<li>Still photography of artworks and posting to social media is permitted.</li>
<li>Flash, tripods, selfie sticks, additional lighting, and commercial photography are prohibited during opening hours.</li>
<li>TJC will photograph the venue for documentation, PR, reporting, and archival purposes, but individual artwork documentation is not guaranteed.</li>
</ul>
<h2>Tickets & Staff Passes</h2>
<ul>
<li><strong>Gallery Staff Pass</strong>: Up to 3 per gallery per day, free of charge.</li>
<li><strong>Guest Passes</strong>: 5 invitation slots will be provided per gallery.</li>
<li><strong>Pass Delivery</strong>: Digital passes (QR code) will be emailed before the event. Names/QR codes will be confirmed at reception on the day.</li>
</ul>
<h2>Event Day Flow</h2>
<ol>
<li><strong>Delivery</strong>: Deliver artworks to the specified time and location (CR① sign-off). Meeting point, delivery entrance, and parking will be detailed in the final load-in/out manual.</li>
<li><strong>Installation Confirmation</strong>: TJC installs the work → post-installation photos are shared → sign the post-installation confirmation document (CR②).</li>

<h2>FAQ</h2>
<p><strong>Q. Are there booths?</strong>
A. No. TJC curates the show and places works throughout the space.</p>
<p><strong>Q. Can we choose our display location?</strong>
A. No. You may share technical requirements, but the final decision is made by TJC.</p>
<p><strong>Q. What costs are there besides the participation fee?</strong>
A. Out-of-pocket costs such as production, shipping, customs, import consumption tax, art insurance, special installation requirements, and payment processing fees.</p>
<p><strong>Q. Do we handle installation ourselves?</strong>
A. No. Galleries deliver the artwork; TJC handles installation.</p>
<p><strong>Q. What happens if an artwork is damaged?</strong>
A. It is covered under the insurance responsible for that period at the time. This is why CR confirmation at delivery, post-installation, and de-install is important.</p>
<p><strong>Q. How is the sales commission calculated?</strong>
A. 10% of the artwork's base sale price. Out-of-pocket costs are excluded.</p>
<p><strong>Q. Can we use an ATA Carnet?</strong>
A. Valid for artworks declared for exhibition purposes only, but works that are sold will incur tax and penalties. For works planned for sale, please consider standard import instead.</p>
<p><strong>Q. Can we take photos?</strong>
A. Still photography of artworks is permitted before opening hours.</p>
<p><strong>Q. When can information be made public?</strong>
A. After September 1st.</p>
<p><strong>Q. Can we revise submissions afterward?</strong>
A. Yes, via the edit link on each form (no need to resubmit).</p>
